Alquatica Terms and Conditions

Effective date: October 17, 2026

These Terms and Conditions govern purchases of, access to, and use of digital products, online courses, downloadable materials, practice assets, and related educational offerings provided by Alquatica LLC through Alquatica-operated websites, Kajabi, and associated checkout or delivery services. Physical merchandise may be governed by separate store terms.

By completing a purchase, checking the required acceptance box, creating an account, or accessing a purchased product, you agree to these Terms. If you do not agree, do not purchase or access the product.

1. About Alquatica and these Terms

In these Terms, “Alquatica,” “we,” “us,” and “our” mean Alquatica LLC. “You” and “your” mean the purchaser and, where applicable, the individual using the product with the purchaser’s authorization. “Product” means the particular digital course, download, resource, asset pack, workshop, or bundle identified on the applicable sales or checkout page.

The product description, checkout page, and any written product-specific terms form part of your agreement with us. If a product-specific term directly conflicts with these general Terms, the product-specific term controls for that Product, except where applicable law requires otherwise.

2. Eligibility and purchases by minors

You must be at least 18 years old and legally capable of entering into a contract to make a purchase.

Individuals aged 13 through 17 may use a Product only when a parent or legal guardian:

  • purchases the Product or expressly authorizes the purchase;
  • reviews and accepts these Terms on the minor’s behalf;
  • supervises the minor’s use of the Product; and
  • accepts responsibility for the minor’s compliance with these Terms.

Our Products are not directed to children under 13. We may cancel an account if we reasonably believe these eligibility requirements have not been met.

3. Product descriptions and educational scope

We aim to describe each Product accurately. The applicable sales page identifies the principal lessons, files, features, and bonuses included with the purchase. Demonstrations, previews, mockups, and examples are illustrative and may reflect creative choices, software versions, or optional tools that are not included with the Product.

Our photography and editing Products provide education in creative methods, artistic decision-making, and software workflows. They do not guarantee any particular artistic, professional, financial, social-media, employment, or business result. Results depend on factors such as your experience, practice, equipment, source images, software, taste, and implementation.

Purchasing a Photoshop-focused Product does not include a Capture One, Lightroom, photography-production, makeup, styling, advanced-editing, or other separate course unless the sales page expressly says it is included. A later course, new edition, advanced workflow, asset collection, or separately named Product may require a separate purchase.

4. Account registration and security

You must provide accurate, current information when purchasing or creating an account. Access is issued to one individual unless a Product description expressly authorizes another arrangement.

You may not share login credentials, permit simultaneous use by multiple people, sell or transfer an account, or use another person’s account. You are responsible for protecting your password and for activity occurring through your account. Notify us promptly at support@alquatica.com if you suspect unauthorized access.

We may require reasonable verification of account ownership before changing login information, restoring access, or responding to a request involving account data.

5. Product access and product lifetime

Unless the applicable sales page states a fixed access period, your purchase includes access for the lifetime of that specific Product offering, subject to these Terms and your continued compliance.

“Lifetime access” means the period during which Alquatica continues to maintain and offer that Product. It does not mean the lifetime of the purchaser, Alquatica’s owner, Alquatica LLC, Kajabi, or any third-party platform, and it is not an unconditional promise of perpetual hosting.

We may update, reorganize, correct, replace, or migrate a Product or its delivery platform. Routine corrections and supplementary materials added to the same Product may be included at no additional charge. A substantially refilmed, renamed, redesigned, expanded, advanced, or successor Product may be sold separately.

If we permanently discontinue a Product, we will make reasonable efforts to provide advance notice and, where technically and legally practical, an opportunity to download materials that were designated as downloadable. Streaming videos, licensed third-party materials, interactive features, and platform-dependent content may not be available for download. We are not responsible for loss of access caused by your failure to maintain a working email address, preserve your login details, or download eligible materials during a stated notice period.

6. Technical and software requirements

You are responsible for obtaining and maintaining the equipment, internet access, storage, operating system, software, subscriptions, and technical ability required to use the Product. Adobe Photoshop, Capture One, Lightroom, fonts, plugins, stock resources, and other third-party tools are not included unless the sales page expressly states otherwise.

Software interfaces, features, file compatibility, pricing, and availability may change. We may identify the software version used in a demonstration, but we do not guarantee that every technique will function identically in earlier or later versions, on every device, or with every third-party plugin. Before purchasing, review the stated requirements and contact us if you need clarification.

We may provide reasonable assistance with Product access, account delivery, and files we supply. We do not provide general computer repair, individualized Adobe or Capture One technical support, or a guarantee that we can resolve problems caused by your equipment, software, internet connection, or third-party services.

7. Ownership of Alquatica content

Alquatica and its licensors retain all rights, title, and interest in the Products and their contents, including videos, photographs, demonstrations, RAW files, JPEG files, PSD files, layered working files, texture files, smoke and magic-effect assets, graphics, illustrations, audio, written lessons, PDF walkthroughs, shortcut guides, templates, downloads, branding, and course organization.

The purchase price pays for a limited license to access and use the purchased Product. It does not transfer copyright, trademark rights, publicity rights, ownership of source files, or any other intellectual-property rights to you.

8. License to course lessons and general educational materials

Subject to payment and compliance with these Terms, Alquatica grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access the purchased Product for your own education.

You may:

  • watch the lessons and use included reference documents for your own learning;
  • download files that Alquatica expressly makes downloadable;
  • print one working copy of a PDF or cheat sheet for your own use; and
  • apply the general techniques, skills, shortcuts, and know-how taught in the Product to photographs and creative works that you own or are independently authorized to use.

You may use your own original finished work commercially, including in client work, your portfolio, prints, licensing, or other lawful creative activity, provided that the finished work does not contain Alquatica Practice Assets or other Alquatica-owned content and does not suggest sponsorship or endorsement by Alquatica.

9. Special license for Practice Assets

Some Products or optional asset packs may include Alquatica-owned source photographs, RAW files, preprocessed images, JPEGs, PSDs, layered files, textures, smoke effects, magic-circle elements, or other materials intended to help you follow along with a lesson. These materials are “Practice Assets.”

Unless a separate written license expressly states otherwise, Practice Assets are licensed only for private, personal, noncommercial educational use. You may use them locally to repeat the demonstrated workflow and create a private practice edit.

You may not:

  • use Practice Assets or a practice edit in paid client work, advertising, sponsorships, merchandise, prints, products, stock libraries, templates, presets, NFTs, licensing, commissions, or any other commercial activity;
  • post, publish, distribute, display, transmit, or upload Practice Assets or a practice edit publicly, including on social media, portfolio sites, forums, cloud galleries, or contests, except a completed practice edit shared as the Student Showcase License allows;
  • share, sell, sublicense, lend, gift, or otherwise provide Practice Assets to another person;
  • extract, isolate, repackage, modify, or redistribute any component as a standalone asset;
  • claim that you photographed, created, own, or exclusively control the underlying Practice Assets;
  • remove copyright notices, metadata, watermarks, or other ownership information;
  • use Practice Assets to create a competing course, tutorial, resource library, asset pack, or training product; or
  • upload Practice Assets to an artificial-intelligence or machine-learning service, use them in a training dataset, or use them to generate replicas of a depicted person, character, voice, likeness, or Alquatica work.

Permission to share a completed practice edit publicly exists only if Alquatica provides a separate written “Student Showcase License” or comparable permission. Any such permission is limited to its stated conditions and does not create commercial rights.

10. Prohibited uses of Products

Except where Alquatica expressly authorizes the use in writing, you may not:

  • reproduce, record, copy, screen-record, republish, upload, distribute, resell, sublicense, translate, or create substitute materials from a Product;
  • share downloads, course videos, screenshots, written lessons, or account access with another person;
  • teach, present, or distribute the Product or substantially similar course materials as your own training;
  • use Product materials to create a competing product or service;
  • circumvent download restrictions, access controls, or platform security;
  • use automated tools to scrape, archive, index, or extract Product content;
  • use Alquatica’s name, logo, branding, trade dress, photographs, likenesses, or Product names in a way that implies affiliation, sponsorship, or endorsement; or
  • use a Product for unlawful, infringing, defamatory, deceptive, harassing, or abusive activity.

Unauthorized use may result in suspension or termination of access and may expose the user to legal claims. Nothing in these Terms restricts rights that cannot lawfully be restricted, including applicable exceptions under copyright law.

11. Payments, prices, and taxes

Prices are displayed in U.S. dollars unless stated otherwise. We may change prices, discounts, bonuses, and future offers at any time. A later price change does not alter a completed purchase, create a right to a refund, or require us to provide a retroactive discount.

Payments may be processed by Kajabi Payments, Stripe, PayPal, or another identified payment provider. Your payment is also subject to that provider’s applicable terms. You authorize the provider to charge the selected payment method for the amount shown at checkout, including applicable taxes.

You are responsible for taxes, duties, currency-conversion charges, bank fees, or similar charges that apply to your purchase, except to the extent we are legally required to collect and remit them. If we offer a payment plan, you authorize each scheduled charge and remain responsible for the full agreed purchase price, subject to rights that cannot legally be waived.

If a charge is unauthorized, duplicated, or incorrect, contact support@alquatica.com promptly. Nothing in these Terms prevents you from exercising a lawful right to dispute a genuinely unauthorized or improper charge.

12. Refunds, cancellations, and digital delivery

Because our digital Products provide immediate access to educational content and may include downloadable files, all sales are final once access or delivery begins. We do not provide refunds, exchanges, credits, or price adjustments for change of mind, failure to use the Product, dissatisfaction based solely on personal preference, lack of required software or equipment that was disclosed before purchase, or failure to achieve a desired creative or business result.

If you cannot access a Product because of an error within our control, contact support@alquatica.com. We will first make reasonable efforts to restore or provide access. We will correct duplicate charges and provide any remedy required when a Product is materially defective, materially misdescribed, not supplied, or otherwise subject to a non-waivable consumer guarantee.

Nothing in these Terms excludes, limits, or modifies a statutory warranty, consumer guarantee, refund right, or other remedy that applicable law does not permit us to exclude. References to “all sales final” apply only to the extent permitted by law.

EU and UK digital-content acknowledgment

Where a statutory cancellation or withdrawal period would otherwise apply, you expressly request that Alquatica begin supplying the digital content immediately. You acknowledge that, once access, streaming, or downloading begins after your express consent, you may lose the applicable right to cancel or withdraw. We will present this acknowledgment at checkout where required and include confirmation in the purchase or access communication.

13. Support and communications

We may send transactional communications needed to administer your purchase, including receipts, account-creation messages, access instructions, security notices, service notices, and responses to support requests. Transactional communications are separate from optional marketing emails.

If you separately consent to marketing, you may unsubscribe using the link in a marketing email. Unsubscribing from marketing does not prevent necessary transactional communications about an existing purchase or account.

Support is provided through support@alquatica.com. Response times are estimates, not guarantees. Please do not send passwords, complete payment-card numbers, or other unnecessary sensitive information by email.

14. Third-party platforms, links, and trademarks

Products may be hosted or delivered through third-party services such as Kajabi and may refer or link to services such as Adobe Photoshop, Capture One, Lightroom, Stripe, PayPal, YouTube, Meta platforms, or other resources. Third parties control their own availability, pricing, functionality, policies, security, and data practices. Your use of a third-party service is governed by that provider’s terms and privacy policy.

Alquatica is not responsible for third-party outages, discontinuations, price changes, account decisions, content, or conduct, although we will make reasonable efforts to address delivery issues within our control.

All third-party names and trademarks belong to their respective owners. References to third-party software, games, fictional genres, characters, or platforms are descriptive or educational and do not imply sponsorship, approval, or affiliation. Alquatica is not affiliated with or endorsed by Adobe, Capture One, Blizzard Entertainment, or other referenced rights holders unless expressly stated.

15. Creative and educational disclaimer

The Products reflect Alquatica’s creative process and professional experience. They are provided for educational and informational purposes and are not legal, financial, medical, tax, or other regulated professional advice.

You are responsible for your creative decisions and for securing permission to use every photograph, model likeness, artwork, font, texture, stock element, trademark, location, or other third-party material incorporated into your own work. Alquatica’s discussion or demonstration of a technique does not grant rights in any third-party material and does not guarantee that a particular use is lawful in your jurisdiction.

16. Availability and changes to Products

We strive to maintain reliable access but do not guarantee uninterrupted or error-free operation. Access may be temporarily limited for maintenance, security, platform outages, updates, migrations, or circumstances beyond our reasonable control.

We may make reasonable changes to lesson order, presentation, files, instructors, links, or technical delivery when doing so does not materially deprive you of the core Product purchased. If a third-party change makes a specific technique or resource obsolete, we may update the lesson or provide a reasonable substitute, but we do not promise indefinite compatibility with every software version.

17. Suspension and termination

We may suspend or terminate access if we reasonably determine that you materially violated these Terms, engaged in fraud, shared an account or Product, infringed intellectual-property or privacy rights, circumvented security, or threatened or harassed another person in connection with the Product.

Except for urgent security issues, fraud, serious abuse, or intentional intellectual-property misuse, we will ordinarily provide notice and a reasonable opportunity to explain or correct the issue. Termination for a material violation does not create a right to a refund. Provisions concerning ownership, licenses, payment obligations, disclaimers, liability, disputes, and other provisions that logically should continue will survive termination.

You may stop using a Product at any time. Stopping use does not undo a completed purchase or terminate any outstanding payment obligation, subject to applicable law.

18. Disclaimers and limitation of liability

To the fullest extent permitted by law, Products are provided on an “as available” basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement to the extent those warranties may lawfully be disclaimed. We do not warrant that a Product will meet every expectation, operate with every configuration, remain error-free, or produce a specific result.

To the fullest extent permitted by law, Alquatica LLC and its owners, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, opportunity, reputation, or data; or the cost of substitute services arising from or related to a Product or these Terms.

To the fullest extent permitted by law, Alquatica’s aggregate liability arising from a particular Product will not exceed the amount you paid directly to Alquatica for that Product during the twelve months preceding the event giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, or other categories protected by applicable law. Some jurisdictions do not allow particular warranty exclusions or liability limitations, so portions of this section may not apply to you.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold Alquatica LLC and its owners, employees, contractors, and agents harmless from third-party claims, damages, and reasonable costs arising from your unlawful misuse of a Product, your unauthorized commercial or public use of Practice Assets, your infringement of another person’s rights, or your material violation of these Terms.

This obligation does not require you to indemnify Alquatica for Alquatica’s own negligence, willful misconduct, or violation of law, and it does not limit non-waivable consumer rights.

20. Informal dispute resolution and governing law

Before filing a formal claim, you and Alquatica agree to make a good-faith effort to resolve the dispute. Send a written description of the issue and the requested resolution to support@alquatica.com. We will aim to respond within 30 days.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Subject to any mandatory consumer right to bring a claim elsewhere, claims not resolved informally may be brought in a state or federal court with competent jurisdiction in Pennsylvania.

Nothing in this section deprives a consumer of protections, remedies, or a legally required forum available under the mandatory laws of the consumer’s place of residence.

21. Privacy

Our collection and use of personal information are described in the Alquatica Privacy Policy posted on our website. The Privacy Policy is incorporated into these Terms by reference. Marketing consent, where requested, is separate from acceptance of these Terms and is not a condition of purchase unless applicable law allows otherwise.

22. Changes to these Terms

We may revise these Terms to reflect changes in our Products, technology, practices, or legal obligations. The version in effect when you purchase generally governs that purchase. Material changes affecting an existing Product will be communicated by reasonable means and will apply prospectively, except where a change is required sooner by law or is necessary to address security or abuse.

Your continued use after the effective date of a properly notified change constitutes acceptance to the extent permitted by law. If a material change substantially reduces an existing contractual right, we will provide any notice or remedy required by applicable law.

23. General provisions

These Terms, the applicable sales page, the Privacy Policy, and any Product-specific written terms constitute the entire agreement concerning the Product and replace prior discussions or representations about it.

If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign or transfer your account, license, or obligations without our written consent. We may assign these Terms as part of a merger, reorganization, sale of assets, or transfer of the applicable business, subject to applicable law.

Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disasters, government action, labor disruption, cyberattack, utility failure, internet failure, or third-party hosting failure. This provision does not excuse payment already due or remove mandatory consumer remedies.

Electronic acceptance and communications satisfy any legal requirement that an agreement or notice be in writing to the extent permitted by law.

24. Contact

25. Acknowledgment

By completing a purchase and accepting these Terms, you confirm that:

  • you reviewed the Product description and disclosed technical requirements;
  • you understand the distinction between techniques you may apply to your own work and Alquatica content or Practice Assets you may not commercially exploit;
  • you understand the Product access and refund terms;
  • you are purchasing for yourself or, if purchasing for a person aged 13 through 17, you are that person’s parent or legal guardian and accept responsibility on their behalf; and
  • you agree to be legally bound by these Terms.
